ok so i was learning gemara and halachot of niddah and it seems that if a girl goes to the mikvah then u can have pre-marital sex....i mean i know u could be breaking tsniut and yichud but dehorita i cant find anything wrong with it...so if ppl did do that would they have to get a "get' afterwards if they break up? also doesnt going to the mikvah anull the need for shomer nagia relationships atleast half of the time? hmmmm if u guys find any answers i would be pretty interested thanx borgz

in reality yes you could touch her if she goes to the mikvah bc she is no longer a nidda but it has been banned for at least the last 1000 years. Girls are not allowed to go to the mikvah until they are married. also, im not sure, but i dont think that u need a get after pre marital sex bc its not leshaim kedushin. NOT THAT I BELIEVE PREMARITAL SEX EVEN NOT BEING A NIDDA IS A GOOD IDEA. sex, whether mutar or not should be left for marriage.

what about if the girl hasnt gone through puberty and therefor hasnt been able to become a nidah yet?

but where does it say that unmarried women cant go to the mikvah? and if they do are they actually breaking a law? also ignoring premarital sex what about premarital touching assuming both parties have gone to the mikvah? i dunno, i mean none of us break these things but are they actually laws or minhagim...and if they r minhagim are they really productive to our society?

yes they are productive to our society, it all depends on your perspective, if you look at sex as the ultimate form of love that should be shared only between two people who love each other very much and as such have gotten married because they love each other, then that is when sex should be saved for, though if you view sex as just being something that feels good and is fun then the laws that have been put in place to make sure sex is saved for marriage are irrelevant to you.

it was prohibited by rabannan, also because prostituion is prohibited in the torah even if a girl does go to the mikvah, since premarital sex is considered prostitution halachically...

There is a prohibition (Itallian Ravs made it about 1000 years ago, and it has been accepted by all of klal Yisrael) for a women to go to the mikveh except when married (and once right before). The pre-martial sex thing is an isur kedeisha (it was in last weeks parsha actually) and thus an isur d'orisa (at least according to Rambam). It seems that according to the Shita Rambam as explained by the Ramban that touching b'derekh chiba would be a chatzi shiur of biah and thus asur in the same prohibition (oooo chidush!). Also I heard from one of my Rabeim that the isur Lo Tinaf (usually no adulturey) although the gemorah says explicitly it means adulturey it also is a prohibition on masseh mitzraim and niuf means any and all sexual immorality (which would include from a Torah perspective premaritial touching even without the nida issue.)
Also, this will likely lead to hotzata zera l'vatala on the guys part (especially considering complete sex is asur) and that is a isur d'orisa chamur.
